  1. Our commitment. Your privacy is important to Glynx Pty Ltd ( we, us). We are committed to respecting the privacy of our customers and others ( you), and to upholding the confidentiality of your personal data, traffic data and communications content.
  2. Our objective. Our objective is to maximise your control over the personal information that you reveal online, including control over who you reveal information to, what information that you share and how it is used. In general, we do not seek to collect personal information from you. However, sometimes this is unavoidable. This policy sets out the basis on which we collect, disclose and protect personal information.
  3. What is personal information? Personal information means information or an opinion (including information or an opinion forming part of a database), whether true or not, and whether recorded in a material form or not, about an individual whose identity is apparent, or can reasonably be ascertained, from the information or opinion.
  4. What personal information do we collect? We collect personal information relating to:
    1. identified or identifiable users of our software or services;
    2. individuals who come into contact with our business, and
    3. individuals whose details are uploaded to us or stored by us relating to them or related users of our software or services,
    for example, name, address, contact details, billing details, occupation and other information that may be stored in a private address book.
    We do not retain information about users who use our software who otherwise do not come into contact with our business. We do not retain beyond a reasonable time information that has been used for identity verification purposes.
  5. How do we collect it? We collect information in the following ways:
    Through contact with our business or our website:
    1. by way of forms filled out by people online or sent to us by fax or post, via telephone conversations (for example, support calls) or face-to-face meetings, via business cards and (where legally permissible) from third parties;
    2. via your usage of our website (which may include, for example, your IP address); and
    3. via use of cookies to make your use of our website as convenient as possible. If you do not wish to receive any cookies you may set your browser to refuse cookies. However, this may mean you may not be able to access some of our online software or services;
    Through usage of the Glynx software or web-based services:
    1. we may observe your identity details if and when you ask us to verify your identity and we may keep these details for a reasonable period in order to facilitate this process;
    2. we may collect the IP address associated with (i) your web browser (in the case of our web-based services) and/or (ii) instances of the software, should the software communicate with our servers and gateways, or should this information be reported to us by other instances of the software;
    3. we may at certain times collect and transmit encrypted content between your web browser and (i) other web browsers and/or (ii) instances of our software; and
    4. we may collect and retain your identity details and other personal information about you, and the identity details and other personal information about others associated with you, when you use our web-based services.
    We do not generate or retain encryption keys that could enable us to decrypt content between users of the software or enable us to identify the identity of such users (except to the extent necessary in order to operate our web-based services).
    We also collect or derive anonymous (ie de-identified) usage statistics of users of our software which do not disclose your individual identity or personal information.
  6. What do we collect it for? We collect this personal information in order to provide the software and services (the primary purpose), in particular to convey the peer-to-peer communications that you make by means of our software and services. We also collect the information for various related secondary purposes, including but not limited to:
    1. conducting our business;
    2. marketing our software and services;
    3. delivering third party advertisements to you;
    4. meeting our legal obligations;
    5. communicating with you;
    6. selling or purchasing from you (such as billing); and
    7. managing, improving, supporting, configuring and enhancing our software and services.
    In many cases, if personal information we request is not provided, we may not be able to supply the relevant software or services
  7. When may we disclose it? We may disclose your personal information to:
    1. other companies or individuals who assist us in providing our software or services or who perform functions on our behalf (such as our mailing house);
    2. courts, tribunals and regulatory authorities if required by law; and
    3. anyone else to whom you authorise us to disclose it (for example, disclosure occurring in the normal course of operation of our software or services).
    In delivering third party advertisements to you, we may give third party advertisers (or their third party service providers) aggregated non-personal information, but we do not sell, rent or otherwise share your personal information with any third parties, except as described elsewhere in this policy.
  8. What if the information we hold is inaccurate? We endeavor to ensure that the personal information we hold is accurate, complete and up-to-date. We encourage you to contact us in order to update any personal information we hold about you. Our contact details are set out below.
  9. How can you access your personal information? You have the ability to gain access to your personal information held by us. Subject to the exceptions set out in applicable privacy legislation, you may gain access to the personal information that we hold about you by contacting privacy@glynx.com. We will require you to verify your identity and to specify what information you require. A fee may be charged for providing access. We will advise you of the likely cost in advance.
  10. Your obligations to third parties. You are responsible for ensuring that you do not misuse personal information that has been provided to you by others, and you must comply with all applicable laws in this regard. You must also comply with all applicable laws and agreements in regard to you providing your personal information to others.
  11. Amending our Privacy Policy. From time to time it may be necessary for us to review and amend this policy. We reserve the right to make such amendments at any time and to notify you by posting an updated version on this website. All personal information held by us will be governed by our most recent policy posted on our website.
